One of the key problems is that commercial software publishers release products with hundreds or thousands of known bugs. I've worked in software publishing for a lot years, especially with software testing groups.

One of testers core frustrations is that they find the bugs, but so many products ship to deadlines rather than to quality levels that too many bugs don't get fixed.

That gives customers a reason to want to take action against publishers, when products fail and cost customers time, money, property, or their sense of safety.
