UCITA in the States

To become law UCITA must be passed in each state as state legislation. Here are the current actions on a state-by-state basis.

Hawaii

Hawaii has had UCITA legislation introduced into both houses:

Iowa

The Iowa House has entered House File 2205 (do a search for the bill number at http://www.legis.state.ia.us/GA/78GA/Legislation/index.html). It has passed the house, with amendments, and goes to the Senate.

May 3, 2000:
The following language passed the Iowa Legislature, and we expect it will be signed by the Governor: A choice of law provision in a computer information agreement, which provides that the contract is to be interpreted pursuant to the laws of a state that has enacted the uniform computer information transactions Act, as proposed by the national conference of commissioners on uniform state laws, or any substantially similar law, is voidable and the agreement shall be interpreted pursuant to the laws of this state if the party against whom enforcement of the choice of law provision is sought is a resident of this state or has its principal place of business located in this state. For purposes of this subsection, a "computer information agreement" means an agreement that would be governed by the uniform computer information transaction Act or substantially similar law as enacted in the state specified in the choice of law provision if that state's law were applied to the agreement.

This language is an amendment to Iowa's UETA bill, House File 2205. Unfortunately language was also added to sunset this provision in one year, July 1, 2001, and there is language stating that the Iowa Legislature shall consider UCITA in the 2001 session.

Illinois

The Illinois bill is S.B. 1309. There will be a Senate hearing on January 26, 2000 at 1:00 p.m.

Maryland

UCITA has been passed in Maryland, to become law on October 1, 2000.

The House UCITA bill is HB 19.

Oklahoma

Senate bill SB1337 was introducted on 2/7/00 by Senator Glenn Coffee. His number is 405-521-5636. Email is coffee@lsb.state.ok.us.

Virginia

As of Feb. 15, 2000, both House and Senate bills have been passed, and the legislature has a joint resolution setting up a study committee to determine the appropriateness of UCITA for "computer information transactions". The law will go into effect July 1, 2001.

The Joint Committee on Technology has set up an Advisory Committee on UCITA. The committee met on November 4th (email announcement), but the meeting was closed to the public.

A meeting of the full commission took place on September 21st. (summary). There was a handout presented by Carlyle Ring.

Washington

The Wall Street Journal reported on 10/11/99 that Microsoft was lobbying the Washington legislature heavily to introduce and pass that state's UCITA legislation.
